Accompanying Driver Agreement

This agreement governs the relationship between Drivzu and individuals who offer supervised practice sessions to learner drivers through the platform.

1.Parties & Relationship

This Accompanying Driver Agreement (Agreement) is between Drivzu Ltd (registered in Dublin, Ireland), operating the Drivzu platform, and the individual who registers as an accompanying driver on the platform (you or the Accompanying Driver).

Drivzu is a technology platform that connects learner drivers with driving professionals and practice partners. By registering as an Accompanying Driver, you acknowledge and agree that:

  • You are an independent contractor and not an employee, worker, agent, or partner of Drivzu.
  • You are not a professional driving instructor. You are providing supervised driving practice, not formal instruction. Only RSA-registered Approved Driving Instructors (ADIs) may provide professional driving instruction.
  • Drivzu does not direct, control, or supervise the manner in which you provide practice sessions, though you must comply with this Agreement and all applicable laws.
  • Nothing in this Agreement creates an employment relationship, and you are not entitled to employee benefits, workers' compensation, or similar entitlements from Drivzu.

This Agreement is subject to our Terms of Service, which apply to all users of the Drivzu platform.

2.Eligibility

To register and offer practice sessions as an Accompanying Driver on the Drivzu platform, you must meet all of the following requirements at all times:

  • You hold a full Irish driving licence that has been held for a minimum of 2 years.
  • Your licence is valid for the relevant vehicle category in which the learner will be practising.
  • You are not disqualified from driving and have not been disqualified at any point in the past 5 years.
  • You have no endorsements that would prevent you from legally accompanying a learner driver.
  • You have a maximum of 3 penalty points on your licence. If your penalty points exceed this threshold, you must notify Drivzu immediately and your account may be suspended.

Drivzu reserves the right to verify your eligibility at any time and to request proof of your driving licence, penalty point status, or other relevant documentation. Failure to provide requested documentation within 7 days may result in suspension of your account.

3.Insurance & Vehicle

You are solely responsible for ensuring that you have appropriate insurance and that your vehicle meets all legal requirements:

  • Motor insurance: You must hold appropriate motor insurance that covers you as a driver and, where applicable, the learner driver while under your supervision. It is your responsibility to confirm with your insurer that your policy covers supervised learner driving.
  • Valid NCT: Your vehicle must have a current National Car Test (NCT) certificate at all times.
  • Motor tax: Your vehicle must be fully taxed in accordance with Irish law.
  • Roadworthiness: Your vehicle must be in a safe and roadworthy condition, with all lights, tyres, brakes, mirrors, and safety equipment in proper working order.
  • Student's own vehicle: Where mutually agreed, practice sessions may take place in the student's own vehicle. In such cases, the student is responsible for ensuring the vehicle is insured, taxed, and roadworthy. You should verify this before commencing the session.

4.Service Standards

When providing supervised practice sessions through the Drivzu platform, you agree to uphold the following standards:

  • Safe practice sessions: You must ensure a safe environment for the learner at all times. Choose appropriate routes for the learner's skill level, avoid hazardous conditions where possible, and be prepared to take control of the vehicle if necessary.
  • Follow RSA guidelines: You must follow all applicable RSA guidelines for accompanied driving, including ensuring the learner displays L-plates and carries their learner permit.
  • No professional instruction: You are providing supervised practice only. You must not represent yourself as a professional driving instructor, offer EDT (Essential Driver Training) lessons, or claim to prepare students for the driving test in a professional capacity.
  • Punctuality: You must arrive at the agreed meeting point on time for each session. If you will be late or cannot attend, notify the student as soon as possible through the platform.
  • Professional conduct: You must behave respectfully and professionally at all times. This includes maintaining a clean and comfortable vehicle, being patient with learners, and refraining from using your phone while the vehicle is in motion. See our Community Guidelines.
  • Sobriety: You must not be under the influence of alcohol, drugs, or any substance that could impair your ability to supervise a learner driver. Breach of this requirement will result in immediate and permanent removal from the platform.

5.Commission & Payment

The following terms govern how you are paid for practice sessions booked through the Drivzu platform:

  • Platform commission: Drivzu charges a 30% commission on the price of each completed practice session. This commission covers platform access, booking management, payment processing, customer support, and marketing.
  • Pricing: The default rate for accompanied practice sessions is EUR 25 per hour. You may adjust your pricing within the range permitted by the platform. Drivzu reserves the right to set minimum and maximum prices.
  • Payout schedule: Earnings are paid out weekly by default, on the following Monday for sessions completed in the previous week.
  • Instant payouts: You may request an instant payout at any time for a fee of EUR 1.50 per transaction.
  • Minimum payout: A minimum balance of EUR 50 is required before a payout is processed. Balances below this threshold will roll over to the next payout cycle.
  • Payment method: All payments are processed through Stripe Connect. You must set up and maintain a valid Stripe Connect account to receive payouts. Drivzu is not responsible for delays caused by Stripe or your banking provider.
  • Tax obligations: You are solely responsible for reporting your earnings and paying any applicable taxes, including income tax and PRSI. Drivzu does not withhold taxes on your behalf. We recommend consulting a tax professional.

6.Distinction from Professional Instruction

It is essential that all parties understand the distinction between accompanied driving practice and professional driving instruction:

  • Accompanying Drivers provide supervised practice sessions to help learner drivers build confidence and experience on the road. This is not formal driving instruction.
  • Only RSA-registered Approved Driving Instructors (ADIs) are authorised to provide professional driving instruction, including the 12 mandatory EDT lessons required before a learner can take the driving test.
  • You must not prepare students for the driving test in a professional capacity, issue certificates of competency, or claim ADI status.
  • Students should be encouraged to book formal lessons with an ADI-registered instructor in addition to practice sessions. The Drivzu platform makes it easy to find and book lessons with approved instructors.

Misrepresenting yourself as a professional instructor is a breach of this Agreement and may also constitute an offence under RSA regulations. Such a breach will result in immediate removal from the platform and may be reported to the relevant authorities.

7.Booking & Cancellation

When you accept bookings through the Drivzu platform, you agree to the following:

  • Accurate availability: You must keep your availability calendar up to date. Only mark times as available when you are genuinely able to provide a practice session. Setting inaccurate availability that leads to frequent cancellations may result in reduced visibility or suspension.
  • 12-hour cancellation window: You may cancel a booking free of charge up to 12 hours before the scheduled session. Cancellations made less than 12 hours before the session may result in a cancellation fee being applied.
  • Impact of cancellations: Frequent cancellations affect your reliability rating and search ranking on the platform. Excessive cancellations (more than 3 in any 30-day period) may result in a warning, temporary suspension, or permanent removal from the platform.
  • No-shows: Failing to attend a confirmed session without notice is treated as a serious breach. Two no-shows within any 60-day period will result in account suspension pending review.

8.Data Processing

By using the Drivzu platform, your personal data will be processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR.

The personal data we collect and process in relation to your role as an Accompanying Driver includes:

  • Your name, email address, phone number, and postal address
  • Driving licence details and penalty point declarations
  • Vehicle registration, insurance, and NCT information
  • Booking history, earnings, and payout records
  • Reviews, ratings, and feedback from students
  • Location data for pickup and session locations
  • Communication records through the platform

We share your data only as necessary to provide the platform services, process payments, and comply with legal obligations. 9.Indemnification

You agree to indemnify, defend, and hold harmless Drivzu Ltd, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Any practice session you provide through the Drivzu platform, including any accident, injury, or property damage that occurs during a session
  • Any breach of this Agreement by you, including failure to hold appropriate insurance or meet eligibility requirements
  • Any breach of applicable law or regulation by you, including road traffic law, RSA regulations, and data protection legislation
  • Any claim by a student, third party, or regulatory body arising from your actions or omissions as an Accompanying Driver
  • Any misrepresentation by you regarding your qualifications, experience, insurance status, or eligibility

This indemnification obligation survives the termination of this Agreement and your removal from the platform.

10.Termination

Either party may terminate this Agreement as follows:

  • Termination with notice: Either you or Drivzu may terminate this Agreement by providing 30 days' written notice to the other party. During the notice period, you must honour all confirmed bookings or arrange appropriate cancellations.
  • Immediate termination by Drivzu: Drivzu may terminate this Agreement and suspend or remove your account immediately, without notice, if:
    • You commit a serious breach of this Agreement, including but not limited to driving under the influence, misrepresenting your qualifications, or engaging in dangerous or illegal conduct
    • You fail to maintain the eligibility requirements set out in Section 2
    • You receive multiple serious complaints from students that are substantiated upon investigation
    • You are convicted of a criminal offence that, in Drivzu's reasonable opinion, makes you unsuitable to provide practice sessions
    • Continued provision of services by you would, in Drivzu's reasonable opinion, pose a safety risk to students or the public
  • Immediate termination by you: You may terminate this Agreement immediately if Drivzu materially breaches its obligations and fails to remedy the breach within 14 days of written notice.

Upon termination:

  • Any outstanding earnings above the minimum payout threshold will be paid to you within 14 business days
  • Balances below the minimum payout threshold (EUR 50) will be paid out as a final settlement within 30 days
  • You must immediately cease representing yourself as a Drivzu Accompanying Driver
  • Sections 9 (Indemnification), 8 (Data Processing), and this Section 10 survive termination

This Agreement is governed by the laws of Ireland. Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Ireland.
