Instructor Agreement
This agreement governs your use of the Drivzu platform as a driving instructor. Please read it carefully before registering as an instructor.
1.Parties & Relationship
This Instructor Agreement ("Agreement") is entered into between Drivzu Ltd, a company registered in Ireland with its registered office in Dublin, Ireland ("Drivzu", "we", "us", "our"), and you, the driving instructor ("Instructor", "you", "your").
Drivzu operates a technology platform that connects learner drivers with RSA-approved driving instructors. Drivzu is a technology platform provider only. By using the Drivzu platform, you acknowledge and agree that:
- You are an independent contractor and not an employee, worker, agent, or partner of Drivzu.
- Nothing in this Agreement creates an employment relationship, partnership, joint venture, or agency arrangement between you and Drivzu.
- Drivzu does not control the manner or method by which you deliver driving instruction. You determine your own schedule, pricing, lesson content, and teaching methods.
- You are responsible for your own tax affairs, insurance, and regulatory compliance.
- Drivzu does not provide driving instruction and makes no representations regarding the quality of instruction provided by any instructor on the platform.
2.Eligibility & Verification
To register and maintain your account as an instructor on the Drivzu platform, you must meet and continuously satisfy the following eligibility requirements:
- Hold a valid RSA Approved Driving Instructor (ADI) registration issued by the Road Safety Authority of Ireland. Your ADI number must be in the format XX-XXXXX (two letters followed by five digits).
- Maintain your ADI registration in good standing throughout the entire duration of your use of the platform. You must promptly notify Drivzu of any changes to your registration status.
- Hold a valid full Irish driving licence for the category of vehicle in which you provide instruction.
- Provide accurate and up-to-date personal information and documentation during registration and at all times thereafter.
Drivzu reserves the right to verify your ADI registration status with the RSA at any time and may request updated documentation.
Important legal notice: Under the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 and related regulations, providing driving instruction without a valid ADI registration is an offence. Penalties may include a fine of up to €2,000 or imprisonment for up to 6 months, or both. Drivzu will immediately suspend any instructor found to be operating without valid ADI registration and will report such activity to the RSA.
3.Insurance Requirements
As an independent driving instructor, you are solely responsible for maintaining all necessary insurance coverage. The following insurance requirements apply:
- Specialised driving instruction insurance is mandatory. Standard personal or commercial motor insurance does not provide adequate cover for driving instruction activities. You must hold a policy specifically designed for approved driving instructors that covers you, your vehicle, and your students during lessons.
- Your instruction vehicle must have a valid National Car Test (NCT) certificate and be fully taxed with current motor tax.
- We strongly recommend you also hold professional indemnity insurance to protect against claims arising from professional advice or instruction you provide.
- You must provide proof of insurance to Drivzu upon registration and whenever your policy is renewed or changed. Failure to maintain adequate insurance will result in immediate suspension of your account.
For detailed information about insurance requirements, please see our Insurance & Safety page.
4.Service Standards
As an instructor on the Drivzu platform, you agree to uphold the following service standards at all times:
- Deliver all instruction in accordance with the RSA Approved Driving Instructor standards and the RSA syllabus for learner drivers.
- Use a roadworthy vehicle that is properly maintained, clean, and equipped with dual controls where required by regulation.
- Be punctual for all scheduled lessons. Arrive at the agreed pick-up location on time and deliver the full duration of the booked lesson.
- Maintain professional conduct at all times, including appropriate language, dress, and behaviour.
- Do not discriminate against any student on the basis of gender, age, race, ethnicity, religion, disability, sexual orientation, or any other protected characteristic under the Equal Status Acts 2000-2018.
- Follow our Community Guidelines and treat all students with respect and courtesy.
5.Commission & Payment
Drivzu charges a commission on each booking completed through the platform. The commission structure is as follows:
- Standard commission rate: 12% of the lesson price (excluding VAT).
- Founding member rate: 6% of the lesson price (excluding VAT). This reduced rate is available to instructors who join during the founding period and will be honoured for the duration specified at the time of registration.
- All commission amounts are subject to VAT at the applicable rate as required under Irish tax law.
Payouts
- Weekly payouts are processed free of charge. Payouts are initiated every Monday for the previous week's completed bookings.
- Instant payouts are available for a fee of €1.50 per payout.
- A minimum payout threshold of €50 applies. Earnings below this threshold will be carried forward to the next payout cycle.
- All payments are processed through Stripe Connect. You must create and maintain a Stripe Connect account to receive payouts. Stripe's own terms and conditions apply.
Changes to Commission
Drivzu reserves the right to change the commission rate with a minimum of 30 days' written notice. Notice will be sent to the email address associated with your Drivzu account. Continued use of the platform after the effective date of any change constitutes acceptance of the new rate.
6.Booking & Cancellation Obligations
As an instructor on the platform, you have the following obligations regarding bookings:
- Maintain accurate availability in your calendar at all times. Only mark times as available when you are genuinely able to provide instruction.
- Respond to booking requests within the timeframe specified on the platform. Failure to respond promptly may result in automatic cancellation and may affect your ranking.
- If you need to cancel a booking, you must do so at least 24 hours before the scheduled lesson start time. Cancellations within 24 hours should only be made in genuine emergencies.
- Repeated cancellations will negatively impact your ranking and visibility on the platform and may result in account review or suspension.
For full details on cancellation policies and their effects, please see our Cancellation & Refund Policy.
7.Rankings & Visibility
Drivzu uses a transparent ranking system to determine the order in which instructors appear in search results and listings. The following parameters are used to calculate rankings:
- Response time — how quickly you respond to booking requests.
- Completion rate — the percentage of accepted bookings that you successfully complete.
- Student rating — your average rating from student reviews.
- ADI verification status — whether your ADI registration has been verified by Drivzu.
- Profile completeness — the extent to which your profile is filled out, including photo, bio, qualifications, and vehicle details.
- Pricing — your lesson pricing relative to the market average.
- Location — proximity to the searching student's location.
Each parameter contributes to your overall ranking score. Drivzu does not guarantee any particular placement in search results.
In compliance with Regulation (EU) 2019/1150 (the Platform to Business Regulation), Drivzu provides the above transparency regarding the main parameters determining ranking. If you believe your ranking has been unfairly affected, you may raise a complaint through our Complaints Procedure.
8.Restriction & Suspension
Drivzu may restrict, suspend, or terminate your account in the following circumstances:
- Breach of this Agreement or any other Drivzu policy.
- Failure to maintain valid ADI registration or required insurance.
- Persistent poor ratings or complaints from students.
- Excessive cancellations or no-shows.
- Fraudulent, illegal, or unsafe conduct.
- Non-compliance with applicable law or regulation.
- Any conduct that brings the Drivzu platform into disrepute.
Notice
Where possible, Drivzu will provide you with reasonable notice before restricting or suspending your account, along with a statement of reasons. In cases involving safety, fraud, or serious legal violations, Drivzu may act immediately without prior notice.
Appeal Process
If your account is restricted or suspended, you have the right to appeal the decision. Appeals should be submitted in writing to legal@drivzu.ie within 30 days of the restriction or suspension. Drivzu will review your appeal and respond within 15 business days.
9.Data Processing
Data protection responsibilities are shared between you and Drivzu as follows:
- Instructor as data controller: You are the data controller for any personal data you collect directly from students outside of the Drivzu platform (for example, lesson notes you maintain independently). You must comply with all applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
- Drivzu as data controller: Drivzu is the data controller for all personal data processed through the platform, including your profile information, booking data, reviews, and communications. Details of how we process this data are set out in our Privacy Policy.
You agree not to use any personal data obtained through the Drivzu platform for purposes other than providing driving instruction as booked through the platform. You must not contact students for marketing purposes using contact information obtained through Drivzu.
For further details on data processing responsibilities and arrangements, please refer to our Data Processing Agreement.
10.Tax Obligations
As an independent contractor, you are solely responsible for all tax obligations arising from your use of the Drivzu platform:
- You are responsible for registering with Revenue, filing all required tax returns, and paying all applicable taxes, including income tax, USC, PRSI, and VAT (if applicable).
- Drivzu does not deduct tax from your payouts. It is your responsibility to set aside appropriate amounts for tax liabilities.
- Drivzu strongly recommends that you seek professional tax advice to ensure you are meeting all your obligations.
DAC7 Reporting
In accordance with Council Directive (EU) 2021/514 (DAC7), Drivzu is required to report certain information about instructors to the Irish Revenue Commissioners. Reporting obligations are triggered when an instructor's activity on the platform meets either of the following thresholds in a calendar year:
- Total earnings exceed €2,000, or
- More than 30 completed bookings.
Information reported may include your name, address, tax identification number, date of birth, and total earnings. By using the platform, you consent to this reporting as required by law.
11.Intellectual Property
By creating a profile and uploading content to the Drivzu platform (including but not limited to your profile photo, biography, qualifications, and any other materials), you grant Drivzu a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content on the Drivzu platform and in connection with the marketing and promotion of the platform.
- You retain ownership of all content you upload. This licence exists solely to enable Drivzu to operate the platform and promote your services.
- The licence will terminate when your content is removed from the platform, subject to a reasonable period required for technical removal.
- You represent and warrant that you have the right to grant this licence and that your content does not infringe on any third party's intellectual property rights.
All Drivzu branding, logos, trademarks, and platform design remain the exclusive property of Drivzu Ltd. You may not use Drivzu's intellectual property without prior written consent.
12.Indemnification
You agree to indemnify, defend, and hold harmless Drivzu Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your driving instruction activities, including any injury, loss, or damage to students or third parties.
- Any issues related to your vehicle, including accidents, mechanical failures, or failure to maintain your vehicle in a roadworthy condition.
- RSA violations, including operating without valid ADI registration or failing to comply with RSA standards.
- Your breach of this Agreement, any Drivzu policy, or applicable law.
- Any claim arising from your negligence or wilful misconduct.
This indemnification obligation survives the termination of this Agreement.
13.Termination
Either party may terminate this Agreement as follows:
- Termination with notice: Either party may terminate this Agreement by providing 30 days' written notice to the other party.
- Immediate termination: Drivzu may terminate this Agreement immediately, without notice, in cases of serious breach, including fraud, safety violations, or criminal conduct.
Effect of Termination
- Upon termination, you must complete all pending bookings that are confirmed at the date of termination, unless Drivzu directs otherwise.
- Any outstanding payouts will be processed in accordance with the normal payout schedule.
- Your profile will be removed from public-facing search results and listings.
- Provisions that by their nature should survive termination (including indemnification, intellectual property licences, and dispute resolution) will remain in effect.
P2B Compliance
In accordance with Regulation (EU) 2019/1150, Drivzu will provide a clear statement of reasons for any termination, including reference to the specific facts or circumstances that led to the decision. You have the right to challenge the termination through our internal complaints process or through mediation.
14.Dispute Resolution
In the event of a dispute arising under or in connection with this Agreement, the following resolution process applies:
Internal Complaint System
Drivzu operates an internal complaint-handling system in accordance with Regulation (EU) 2019/1150. You may submit a complaint at any time by emailing legal@drivzu.ie or through our Complaints Procedure. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 business days.
Mediation
If a dispute cannot be resolved through the internal complaint system, either party may refer the matter to mediation. Mediation will be conducted in accordance with the Mediation Act 2017 by a mediator agreed upon by both parties, or failing agreement, appointed by the Mediators' Institute of Ireland.
Governing Law & Jurisdiction
This Agreement is governed by and construed in accordance with the laws of Ireland. Subject to the mediation process above, the courts of Ireland shall have exclusive jurisdiction to settle any dispute arising under or in connection with this Agreement.
