Terms of Service

Please read these terms carefully before using the Drivzu platform. By creating an account or using our services, you agree to be bound by these terms.

1.Introduction & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Drivzu Ltd, a company registered in Ireland with its registered office in Dublin, Ireland ("Drivzu", "we", "us", or "our").

By accessing or using the Drivzu website at drivzu.com, our mobile applications, our AI voice assistant, or any other services we provide (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy.

If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.

2.Platform Description & Role

Drivzu is an online marketplace that facilitates connections between learner drivers ("Students") and RSA-approved driving instructors ("Instructors") in Ireland. Our Platform enables Students to discover, book, and pay for driving lessons with qualified Instructors.

It is important that you understand the following about our role:

  • Drivzu is not a driving school. We do not provide driving instruction directly.
  • Drivzu is not an employer of Instructors. Instructors are independent professionals who use the Platform to offer their services.
  • Drivzu does not control or direct the manner in which Instructors deliver driving lessons.
  • The contractual relationship for driving lessons is directly between the Student and the Instructor. Drivzu acts solely as an intermediary facilitating this connection.
  • Drivzu does not guarantee the availability, quality, or outcome of any driving lesson booked through the Platform.

Instructors listed on the Platform are required to hold a valid RSA-approved Approved Driving Instructor (ADI) licence. However, it is the Instructor's responsibility to maintain their credentials, and Drivzu performs verification checks on a reasonable-efforts basis only.

3.User Eligibility

To use the Drivzu Platform, you must:

  • Be at least 17 years of age (the minimum age to apply for a learner permit in Ireland).
  • Provide accurate, current, and complete information during registration and keep your account information up to date.
  • Maintain only one account per person. Creating multiple accounts is prohibited and may result in suspension or termination of all accounts.
  • Have the legal capacity to enter into a binding contract under Irish law.
  • Not have been previously banned or removed from the Platform.

If you are under 18, you confirm that you have the consent of a parent or legal guardian to use the Platform and that they have read and agreed to these Terms on your behalf.

4.Account Registration & Security

To access certain features of the Platform, you must create an account. You may register using:

  • Email and OTP (One-Time Password): We send a verification code to your email or phone number each time you sign in.
  • OAuth (Social Login): You may sign in using your Google, Facebook, or Apple account. By doing so, you authorise the relevant provider to share certain profile information with us, as described in our Privacy Policy.
  • Multi-Factor Authentication (MFA): We support TOTP-based multi-factor authentication for enhanced account security. We strongly encourage all users to enable MFA.

You are responsible for:

  • Maintaining the confidentiality and security of your account credentials.
  • All activities that occur under your account, whether or not you authorised them.
  • Notifying us immediately at hello@drivzu.ie if you suspect any unauthorised access to or use of your account.

Drivzu will not be liable for any loss or damage arising from your failure to maintain the security of your account.

5.Booking & Service Terms

The Platform allows Students to browse Instructor profiles, check availability, and book driving lessons. The booking process works as follows:

  • Searching & Selecting: Students can search for Instructors by location, availability, vehicle type, pricing, and ratings. Our AI voice assistant can also help you find and book lessons.
  • Payment Hold: When you initiate a booking, a temporary payment hold of 15 minutes is placed on your chosen payment method to secure the time slot. If the booking is not confirmed within this period, the hold is released.
  • Confirmation: A booking is confirmed only when the Instructor accepts it and payment is successfully processed. You will receive a confirmation notification via email and/or in-app notification.
  • Lesson Delivery: The driving lesson is provided directly by the Instructor. Drivzu is not a party to the lesson itself.

No-Show Policy

If a Student fails to attend a confirmed booking without prior cancellation (a "No-Show"), the full lesson fee may be charged. If an Instructor fails to attend, the Student is entitled to a full refund. Repeated no-shows by either party may result in account restrictions.

6.Payment Terms

All prices on the Platform are displayed in Euro (EUR). Where the Instructor or driving school is VAT-registered, VAT at the applicable rate (currently 13.5% for driving instruction services) is included in the listed price. Payment processing is handled securely by Stripe. Drivzu does not store your full payment card details.

Commission Structure

Drivzu charges Instructors a commission on each completed booking. Our commission rates are transparent:

  • Standard rate: 12% of the lesson fee.
  • Founding Instructor rate: 6% of the lesson fee, available to Instructors who join the Platform during the early-access period.

Commission is deducted before Instructor payouts. Students pay the listed price with no additional platform fees.

Instructor Payouts

Instructor earnings are paid out via Stripe Connect to the bank account registered on their Instructor profile. Payout schedules and minimum thresholds are detailed in the Instructor Agreement.

Refunds

Eligible refunds are processed within 14 days of approval. Refunds are returned to the original payment method. For complete refund eligibility criteria, please refer to our Cancellation & Refund Policy.

7.Voice Agent Terms

Drivzu offers an AI-powered voice assistant to help you search for Instructors, book lessons, and get information about the Platform. By using the voice assistant, you acknowledge and agree to the following:

  • The voice assistant is an artificial intelligence system, not a human. It uses natural language processing and speech synthesis to interact with you.
  • Your voice data is processed in real time by the following third-party services:
    • LiveKit - real-time audio streaming infrastructure
    • Deepgram - speech-to-text transcription
    • Google Gemini - large language model for understanding and generating responses
    • Cartesia - text-to-speech voice synthesis
  • Voice sessions are processed on a consent basis. You consent to voice data processing when you initiate a voice session.
  • You may opt out of voice data processing at any time by ending the voice session. You can always use the Platform's text-based interface instead.
  • Voice data is processed transiently and is not permanently stored by Drivzu after the session ends, unless otherwise stated.

8.Reviews & Content

Drivzu allows Students to leave reviews for Instructors after completed lessons. Our review system is designed to be fair, transparent, and compliant with the EU Omnibus Directive (Directive (EU) 2019/2161):

  • Verified Reviews Only: Reviews can only be submitted for bookings that have been completed and confirmed on the Platform. This ensures that all reviews are based on genuine experiences.
  • Editing Window: You may edit your review within 7 days of submission. After this period, reviews become permanent.
  • No Fake Reviews: We do not permit paid, incentivised, or fabricated reviews. We take reasonable steps to detect and remove suspicious reviews.
  • Moderation Rights: Drivzu reserves the right to remove or moderate reviews that violate our Community Guidelines, contain abusive language, personal attacks, discriminatory content, or are otherwise inappropriate.
  • Instructor Responses: Instructors may respond publicly to reviews left on their profile.

By submitting a review or any other content to the Platform, you grant Drivzu a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute such content in connection with operating the Platform.

9.Intellectual Property

All intellectual property rights in the Platform, including but not limited to the website design, logos, trademarks, text, graphics, software, source code, and underlying technology, are owned by or licensed to Drivzu Ltd.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Platform or its content without our prior written consent.
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform.
  • Use any automated means (bots, scrapers, crawlers) to access or collect data from the Platform without our express permission.
  • Use Drivzu's trademarks, logos, or branding in any way that suggests endorsement or affiliation without written authorisation.

User Content Licence

You retain ownership of any content you submit to the Platform (such as reviews, profile information, and photos). However, by submitting content, you grant Drivzu a non-exclusive, worldwide, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, display, and distribute that content for the purposes of operating and promoting the Platform.

10.Limitation of Liability

To the maximum extent permitted by applicable law, Drivzu's total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of:

  • The total fees you have paid to Drivzu in the 12 months preceding the event giving rise to the claim; or
  • EUR 100.

To the maximum extent permitted by applicable law, Drivzu shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, or business opportunities.
  • Damages arising from the actions, omissions, or conduct of any Instructor or third party.
  • Service interruptions, technical failures, or errors on the Platform.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under Irish or EU law.

11.Indemnification

You agree to indemnify, defend, and hold harmless Drivzu Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your breach of these Terms or any applicable law or regulation.
  • Your use or misuse of the Platform.
  • Any content you submit, post, or transmit through the Platform.
  • Your violation of any third party's rights.
  • Any dispute between you and an Instructor or other user of the Platform.

This indemnification obligation shall survive the termination of your account and these Terms.

12.Termination

Termination by You

You may close your account at any time by using the account settings on the Platform or by contacting us at hello@drivzu.ie. Upon closure:

  • Any pending bookings will be cancelled and refunded where applicable.
  • Your profile and associated data will be handled in accordance with our Privacy Policy.
  • Outstanding payments owed to or by you will be settled in accordance with these Terms.

Termination or Suspension by Drivzu

We may suspend or terminate your account, with notice, if we reasonably believe that:

  • You have breached these Terms or any applicable law.
  • Your conduct poses a risk to the safety or wellbeing of other users.
  • Your account has been involved in fraudulent or abusive activity.
  • You have provided false or misleading information during registration.

Where possible, we will provide notice before suspension or termination and give you an opportunity to remedy the breach. In urgent cases involving safety or legal compliance, we may act immediately.

Instructor-Specific Provisions

For Instructors, we will provide at least 15 days' notice before implementing any changes to terms that materially affect your use of the Platform, in compliance with the EU Platform-to-Business (P2B) Regulation.

13.Dispute Resolution

Internal Complaints

If you have a complaint about the Platform or another user, please contact us at hello@drivzu.ie or use our Complaints Procedure. We aim to acknowledge complaints within 2 business days and resolve them within 15 business days.

Alternative Dispute Resolution (ADR)

If we are unable to resolve your complaint internally, you may refer the matter to an approved Alternative Dispute Resolution (ADR) body. The European Commission also provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

Jurisdiction & Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

Nothing in this section shall affect your statutory rights as a consumer under EU or Irish law, including your right to bring proceedings in the courts of your country of residence.

14.Changes to Terms

Drivzu reserves the right to update or modify these Terms at any time. When we make changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Notify you of material changes via email or in-app notification with reasonable advance notice.
  • For Instructors, provide at least 15 days' notice before changes take effect, in accordance with the EU Platform-to-Business (P2B) Regulation.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Platform and close your account.

15.General Provisions

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other policies or agreements referenced herein, constitute the entire agreement between you and Drivzu regarding your use of the Platform. They supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral.

Force Majeure

Drivzu shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, strikes, government actions, power failures, internet or telecommunications failures, or cyberattacks.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it at a later time.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Drivzu may assign its rights and obligations under these Terms without restriction.
